1. Acceptance of Terms

By accessing and using ProfileSpider (the "Service"), including our browser extension and website, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ProfileSpider is a browser extension and web service that allows users to:

• Extract publicly available profile information from websites for personal use
• Organize and manage contact information in lists
• Export contact data in various formats (CSV, JSON)
• Store data locally in the user's browser

The Service is designed for individual productivity and personal contact management purposes.

3. User Responsibilities and Acceptable Use

3.1 Compliance with Laws and Third-Party Terms

You agree to:

• Use the Service only for lawful purposes and in accordance with applicable laws
• Respect and comply with the terms of service of all websites you visit
• Obtain appropriate consent when collecting personal information
• Use extracted data responsibly and ethically
• Not use the Service for spam, harassment, or unsolicited communications

3.2 Prohibited Uses

You may NOT use ProfileSpider to:

• Violate any website's terms of service or robots.txt file
• Extract data for commercial resale or mass distribution
• Collect sensitive personal information without consent
• Bypass website security measures or rate limiting
• Create automated or bulk extraction scripts
• Use the data for illegal activities or harassment
• Violate privacy laws (GDPR, CCPA, etc.)

3.3 Rate Limiting and Fair Use

ProfileSpider implements credit-based usage limits to ensure fair use and compliance with website policies. Users must respect these limits and not attempt to circumvent them. Abuse of scraping limits or unusually high volume activity may result in account review, temporary restrictions, or permanent suspension of service at our sole discretion.

3.4 Account Registration Requirements

To maintain service quality and prevent abuse, users must register with valid, permanent email addresses. The use of disposable, temporary, or "throw-away" email services is strictly prohibited. We reserve the right to suspend or terminate accounts that use disposable email addresses without prior notice.

4. Data and Privacy

4.1 User Data Storage

ProfileSpider stores extracted profile data locally in your browser using IndexedDB. We do not have access to this locally stored data and it never leaves your device unless you explicitly export it.

4.2 Account Information

We collect minimal account information (email, name) through third-party authentication providers solely for account management and service provision.

4.3 Usage Analytics

We collect anonymized usage statistics to improve the service, including credit usage and feature utilization, but not the actual extracted profile data.

4.4 Data Storage and Tracking Technologies

ProfileSpider uses minimal tracking technologies focused on essential functionality:

• Essential Website Cookies: Required only for basic website functionality and session management. These are minimal and necessary for the service to work.
• Local Storage (Browser): JWT authentication tokens, user preferences (theme settings), extension settings, and cached user data stored locally in your browser.
• WebSocket Connections: Authenticated real-time connections for credit updates and subscription changes. These use your JWT token for authentication.
• Extension Bridge Data: Local communication data between the Chrome extension and website for seamless user experience.

Third-Party Services: We use third-party authentication providers (Google OAuth) which may set their own cookies according to their privacy policies. We also use Stripe for payment processing, which may use cookies for fraud prevention and secure payment processing.

Important: We do NOT use analytics cookies, tracking pixels, or other monitoring technologies beyond what's essential for service functionality.

Data Control: You can clear your browser's local storage and data at any time to remove stored tokens and preferences. Essential cookies can be controlled through browser settings, but disabling them may affect website functionality.

4.5 Data Retention Policy

ProfileSpider maintains the following data retention practices:

• Account Information: Retained for the duration of your active account plus 30 days after account deletion to handle billing disputes and provide customer support.
• Billing Records: Maintained for 7 years as required by applicable financial regulations and tax laws.
• Usage Analytics: Anonymized usage statistics are retained for up to 2 years for service improvement purposes.
• Support Communications: Customer support tickets and communications are retained for 3 years to improve service quality.
• Local Profile Data: Data extracted by users is stored locally in their browser and is never transmitted to our servers. Users control retention and can delete this data at any time.
• Authentication Logs: Security and access logs are retained for 90 days for fraud prevention and security monitoring.
• Email Communications: Marketing and transactional email records are retained according to email service provider policies (typically 30 days to 1 year).

Data Deletion: Upon account deletion, we will delete your personal account information within 30 days, except for billing records and anonymized analytics data which may be retained longer as outlined above. You can request immediate data deletion by contacting us at legal@profilespider.com.

Legal Holds: In cases of legal disputes, investigations, or regulatory requirements, we may be required to retain data beyond these standard periods.

5. Intellectual Property

The ProfileSpider service, including its design, functionality, and code, is owned by ProfileSpider and protected by intellectual property laws. Users retain ownership of data they extract, subject to the rights of the original data owners and applicable laws.

6. Disclaimers and Limitations

6.1 Service Availability

ProfileSpider is provided "as is" without warranty of any kind. We do not guarantee continuous, uninterrupted, or error-free operation of the service.

6.2 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of extracted data. Users are responsible for verifying the accuracy of any information they collect.

6.3 Third-Party Websites

ProfileSpider extracts data from third-party websites. We are not responsible for the content, policies, or practices of these websites.

7. Limitation of Liability

To the maximum extent permitted by law, ProfileSpider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

8. Indemnification

You agree to indemnify and hold harmless ProfileSpider from any claims, damages, losses, liabilities, and expenses arising out of your use of the service, violation of these terms, or infringement of any rights of another.

9. Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these terms or for any other reason at our sole discretion. Upon termination, your right to use the service will cease immediately.

10. Payment and Subscription Terms

10.1 Subscription Plans

ProfileSpider offers both free and paid subscription plans. Free plans include limited credits, while paid plans offer additional features and higher credit allowances. Paid plans are available with monthly or yearly billing. Yearly plans provide a discounted rate and grant all credits upfront for the year.

10.2 Billing and Refunds

Paid subscriptions are billed in advance on a monthly or yearly basis and are non-refundable except as required by law. You may cancel your subscription at any time through the customer portal. Cancellations take effect at the end of your current billing cycle — you retain access to your plan and credits until then.

10.3 Plan Changes

You may upgrade, downgrade, or switch between monthly and yearly billing at any time. All plan changes take effect at the end of your current billing cycle. No prorated charges or refunds are issued for mid-cycle plan changes.

10.4 Topup Credits

In addition to subscription credits, you may purchase one-time topup credits. Topup credits never expire and are non-refundable once purchased. They are preserved across billing cycles and subscription changes.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
